NOTICE IS HEREBY GIVEN that a public hearing will be held by the Zoning Board of Appeals of the Town of Wallkill, New York on Monday, June 8, 2020 at 7:30 p.m., or as soon thereafter as can be heard on said date. 

Due to public health and safety concerns related to the COVID-19 Pandemic, the ZBA will NOT be meeting in person.  In accordance with the Governor’s Executive Order 202.1, the June 8, 2020 ZBA public hearing will be held remotely via video conferencing and telephone conference call; and a transcript will be available at a later date.  The public WILL have the opportunity to hear the meeting live and provide comments.

The ZBA meeting will commence at 7:30 p.m. and shall be conducted through a web-based video conferencing tool (and via telephone) that will allow the ZBA board members, staff and the public to participate electronically and remotely.  To participate in the ZBA’s June 8, 2020 meeting please contact the ZBA Clerk by telephone at (845) 692-7800 ext. 141 or e-mail at  This email address is being protected from spambots. The ZBA application to be heard is by DABA63 LLC for variances from §249-9.C(6) and §249-20.D(1) of the Town’s Zoning Code (the “Code”). The applicant is proposing to construct a 6 ft. high fence when the Code limits the fence height on corner lots at 4 ft. The applicant is also requesting a rear yard setback of 6.0 ft. when the Code requires 30 ft. in order to legalize an existing deck.  The property is situated at Section 95, Block 1, Lot 2 in the Town of Wallkill with an address of 63 Ebert Road and is located in the Suburban Residential District (R-2).  

The Zoning Board of Appeals will consider all verbal and/or written statements from all persons interested in the proposed variance in the various manners described above.  The Zoning Board of Appeals will also consider such further relief as it finds necessary.
